August 23, 2006, Mr. Alfred A. Corea, Director, NOAA Civil
Rights Office authorized ABLEN Consulting to conduct No FEAR
Act Training NOAA-wide. No FEAR, an acronym for Notification
and Federal Antidiscrimination and Retaliation Act of 2002,
training also satisfies the NOAA Administrative Order (NAO)
215-101 requirement for periodically updating the equal employment
opportunity (EEO) training of managers and supervisors.
Background:
On July 20, 2006, the Office of Personnel Management (OPM)
issued its final rule implementing the Notification
and Antidiscrimination and Retaliation Act of 2002 (No FEAR)
training requirements. It requires all Federal agencies
to provide training to employees on their rights and remedies
under antidiscrimination, retaliation, and whistleblower
protection laws. Further the final rule states that agencies
must: (1) train all current employees by December 17, 2006;
(2) train all new employees within 90 days of hire; and
(3) provide refresher training to all employees every two
years.
Primarily,
the Act requires that Federal agencies be accountable for
violations of antidiscrimination and whistleblower protection
laws, and that each Federal agency post on its public web
site certain statistical data relating to Federal sector
equal employment opportunity (EEO) complaints filed with
the agency. The data is intended to assist Congress, Federal
agencies and the public in assessing whether, and the extent
to which, agencies are living up to the EEO responsibilities.
The
ABLEN Consulting program is designed to educate members of
the Federal workforce on the Notification And Federal
Employee Antidiscrimination And Retaliation Act of 2002 (No
FEAR Act), P.L. 107-174 signed into law by President
George W. Bush on May 15, 2002. Participants will focus on
conduct and behavior that may constitute unlawful employment
discrimination, whistleblowing retaliation, or prohibited
personnel practices in the Federal workplace that violate
the No FEAR Act, as well as understand rights and remedies
applicable under these laws.
PROGRAM
OBJECTIVES:

Learn to recognize and identify conduct and behavior that
may cause discriminatory or retaliatory acts prohibited by
the law;
· Learn to understand and identify the administrative
processes for resolving complaints using the EEO or whistleblower
complaint systems or agency grievance processes;
· Understand the reporting requirements under the law
and its relationship to other Federal laws protecting employee
civil and security rights; and
· Understand ways to responsibly use agency processes
for addressing No FEAR matters

TARGETED
AUDIENCE: Sessions tailored for management and non-management
staff or could be delivered in a combined group. Workforce
management/human resources staff, EEO and special emphasis
